Conditions of Use of the Campsite
These Terms and Conditions of use, including the Campsite Rules and our price list (the “Terms”) set out the entire agreement for the supply of our services to you. Only these Terms shall apply to our contract with you.
Please check that the details in these Terms and Conditions and your booking request are complete and accurate before you commit yourself to the contract.
If you think that there is a mistake, please make sure that you ask us to confirm any changes in writing, as we can only accept responsibility for statements and representations made in writing by our authorised employees and agents.
Please ensure that you read and understand these Terms before you submit your booking request. You may only request a booking if you agree to these Terms. By submitting a booking request you are deemed to have accepted these Terms. This does not affect your statutory rights as a consumer.
The Central Yorkshire County Scout Council (referred to as “we/our/us”) sells camping and indoor accommodation through our Website, email and in person at the Campsite. Any person wishing to make a booking via any of these methods (referred to as “you/your”) acknowledges that such booking is made subject to these Terms. References to “you” or “your” include each and every member of your party.
References to the Manager include any member of our staff (paid or volunteer).
We reserve the right to change these Terms at any time. Any such changes will take effect immediately when posted on the Website, in our literature, at the Campsite, or otherwise brought to your attention. It is your responsibility to read the Terms each time you submit a booking request and any such request shall signify that you have accepted to be bound by the latest set of Terms. A copy of the latest set of Terms is available on the Website and upon request.
Making a Booking
You can make a booking with the Booking Secretary. Please provide full details specified on the booking form when making a booking as we cannot be held responsible for errors in information provided at the time of booking.
If you are booking as a non-Scouting or non-Guiding Group then you, or somebody in your party, must be at least eighteen years old. The site is not available for public camping, only properly constituted groups with established safeguarding procedures are allowed on site.
Please be aware that all bookings are made on the understanding that responsibility for cleaning the accommodation lies with the booking party. Camping parties will be expected to contribute to cleaning the communal toilet block. If additional cleaning is required after the party’s departure then an appropriate charge will be made.
Any damage to the premises will be charged to the booking party.
Bookings are not transferable
When making a booking you agree that you:
- accept the Terms; and
- have the authority of all people in your party to book on their behalf;
- you are responsible for any loss or damage you (including any member of your party) may cause;
- sub-letting of any accommodation is not allowed
Visitors
Visitors may be permitted at the discretion of the booking secretary. Prices for visitors are set out in our current price list, Visitors must report to the reception/make themselves known to the Duty Manager on arrival. Visitors are required to leave the Campsite by 11pm.
Prices & Charges
See the charges for full details. The Campsite is not registered for VAT so there isn’t any VAT chargeable.
Our prices and charges are based on a daily rate unless otherwise stated. Whilst we will make every effort to ensure that our prices remain unchanged, they may be amended at any time prior to payment of the final balance. NB: A daily rate shall be taken as a 24 hour period. If you wish to arrive in the morning and leave evening of next day you will be charged for a night stay rate plus a Day rate. A weekend is taken as arrival Friday after 4.30pm and departure before 4pm Sunday.
Prices and charges do not include any activities, additional services, features and facilities unless expressly stated.
Payment
Payment can be made by cheque or bank transfer.
A non-refundable deposit is payable at the time of booking, with the minimum payment listed on the charges sheet being due. Groups will be invoiced for the balance after the visit so that any changes can be taken into consideration. Payment is due within 30 days from the date of invoice.
Activities, Services, Features and Facilities
Information relating to activities, services, features and facilities will be available on the Website or displayed in the reception area on the Campsite. Information is, to the best of our knowledge and belief, accurate at the time of publication. Facilities or services referred to are subject to availability and may be supplied by third parties. You use these services, features and facilities at your own risk.
Activity bookings are made separately to Campsite bookings.
Participation in activities is subject to the instructor’s discretion. Any failure to comply with proper instruction will result in withdrawal of the activity for any member of your party who does not comply. No refund shall be given in such circumstances.
Cancellation and changes to your booking
If you cancel your booking at any point after booking and within three months before your arrival at the Campsite your deposit will be returned.
If you cancel within 28 days of your booked arrival date you will be required to pay the full amount unless we are able to re-book the accommodation.
If you leave the early for any reason we will not issue any refund for unused nights.
Unfortunately, in some circumstances we may have to cancel your booking. In these circumstances we will offer you a full refund of any fees paid or the option of an available alternative pitch or building (you will receive a refund in respect of a price difference). No other compensation is available.
If you want to amend your booking, you must notify us as soon as possible. Amendments to your booking are subject to availability.
Arrival and Departure
It is important that you report to the Campsite Reception on arrival. Before pitching tents or accessing any buildings we must have an “emergency contact” who can be contacted by the site in an absolute emergency. Groups are responsible for their own home in touch method.
Please note the earliest arrival time on a Friday for a weekend booking is normally 5pm. If you wish to arrive earlier, please contact angela.foley@cycscouts.org.uk prior to your booked arrival date. Arrivals before 5pm may be subject to an additional charge. Please inform the site manager if you are likely to arrive late.
For advance bookings, if not notified otherwise, your pitch or building will be held until 8pm on the day of your planned arrival, after which it will available for re-letting and your booking treated as a cancellation with your monies retained.
Clearance must be obtained from the Duty Managerbefore departure. A time for checking cleanliness of buildings & campsites must be arranged with the Duty Manager in advance. On Saturdays in the school summer holidays you must leave the Campsite by noon if that is your day of departure. Departures after noon are subject to availability and an additional charge. The latest departure time on a Sunday is 4pm.
The Campsite may be used for recreational camping, short term indoor accommodation holidays and for any other purpose agreed with the Booking Secretary. The maximum stay allowed is 28 days, after which time the Campsite must be vacated for at least three days before you return. You may only extend your stay up to a maximum of two 28-day periods within one year.
Liability
Please read this section as it is important that you understand what you are agreeing to.
Nothing in this section limits or attempts to limit our liability to you for:
- death or personal injury caused by our negligence; or
- fraud or fraudulent misrepresentation; or
- any other matter for which it would be illegal or unlawful for us to exclude or attempt to exclude our liability.
Subject to the matters detailed above, if we fail to comply with these Terms, we shall not be responsible for any losses that you suffer as a result, except for those losses which we could reasonably foresee would result from our failure to comply with these Terms.
In addition, we shall not be responsible for:
- loss of income or revenue;
- loss of business;
- loss of anticipated savings;
- loss of data;
- indirect losses;
- damage, injury or inconvenience caused by plants, animals or insects;
- loss or damage to your property or belongings or those of anyone in your party;
- loss, damage or injury in relation to any services, features or facilities provided or supplied by third parties;
- anything that is outside of our reasonable control, including natural disaster, fire, adverse weather conditions, war, civil unrest, industrial action, terrorist activity, foot and mouth disease and all other similar events. We will endeavor to manage any problems caused as a result of any such event but shall be under no obligation to do so and shall not be liable to you for any losses caused.
Our maximum liability to you shall be no more than to refund the amount paid by you for the stay in which our liability arose.
Any reference to products, services or other information belonging to third parties does not imply or constitute an endorsement, sponsorship or recommendation by us. Links to other services not operated by us are provided solely for your convenience.
Complaints
Should you have cause for complaint, please contact our Site Manager immediately who will try to resolve your complaint and advise you of our complaints procedure.
We ask you to note that if you do not give us the opportunity to resolve the problem by reporting it on the Campsite, we may not be able to deal with any complaint on your return and your rights to claim may have been reduced or forfeited.
If, at the end of your stay with us, you feel we have not dealt with your complaint satisfactorily, we ask that the main booker submits a written complaint within 28 days of your return home to the Site Manager by email or through our website contact details
Information about you
We may request that you supply us with personal information. Generally this information is requested when you request information and/or services from us. We may gather and use information about you in the following ways:
We may monitor Website usage and customer traffic patterns to help us improve the design and layout of our website and provide content that is of interest to you.
We will use your personal information and information we obtain from other sources for administration and customer services, for marketing, to deliver our services to you and to ensure that the content, services and advertising that we offer are tailored to your needs and interests. We may need to share your information with our service providers and agents for these purposes.
This website does not issue or require cookies, hence we do not use information obtained about you from cookies (files which are sent to us by your computer or other access device).
By making a booking request you consent to our processing your personal data for the above purposes.
Other Important Information
Any photographs, descriptions or advertising we issue, and any descriptions or illustrations contained in any literature or on our Website, are issued or published solely to provide you with an approximate idea of our Campsite and services. They do not form part of the contract between you and us.
If any court or competent authority decides that any of the provisions of these Terms are invalid, unlawful or unenforceable to any extent, the Term will, to that extent only, be severed from the remaining Terms, which will continue to be valid to the fullest extent permitted by law.
If we fail at any time while these Terms are in force, to insist that you perform any of your obligations under these Terms, or if we do not exercise any of our rights or remedies under these Terms, that will not mean that we have waived such rights or remedies and will not mean that you do not have to comply with those obligations. Any waiver of a default by us does not mean that we will automatically waive any subsequent waive by you. No waiver by us of any of these Terms shall be effective unless we expressly say that it is a waiver and we tell you so in writing.
A person who is not party to these Terms shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.
You may not transfer any of your rights or obligations under these Terms to another person without our prior written consent, which we will not withhold unreasonably. We can transfer all or any of our rights and obligations under these Terms to another organisation, but this will not affect your rights under these Terms.
Third party organisations are not allowed on site with the intention of supplying on-site groups with any activities without prior agreement (a payment may be required).
These Terms and any non-contractual obligations relating to these Terms shall be governed by and interpreted in accordance with English law. You and we both agree to the exclusive jurisdiction of the English courts. This contract shall be concluded in the English language.
